From January 1, 2021, the application of the Electronic Building Identity (EBI) was activated, which is an electronic file that will include all the data and the history of the property, ie from the initial building permit and its respective revisions, the possible settlements, any legal acts (contracts, etc.), certificates, maintenance, and repairs, etc.
The operation of the HTC will be optional for the first month of implementation, but from February 1, the registration of the HTC will be mandatory for both new buildings and shared properties, ie apartments, shops, etc., for which new building permits are issued, as well as for the older buildings in case of their transfer, while at the moment it is not necessary to issue an EBI if the property does not change owner.
EBI is required for the purchase and sale of real estate and the certificate of completion of EBI from the digital platform “Building Identity” must be attached to the contract, while a time limit of 5 years is given for specific categories of real estates, such as public buildings, premises (theaters, cinemas, event halls, etc.), gas stations, tourist accommodation over 300 sq.m. clinics and treatment areas, public and private schools.
Electronic Identity documents of the Whole Building
a) the executive of the building permit of the building with its revisions,
b) the plans that accompany the building permit as well as the study of the accessibility of the disabled and disabled persons, if required. If the building permit and the accompanying data are not found in the records of the relevant service, a certificate of loss is submitted instead by the competent Building Service.
c) the energy performance certificate of the building or parts thereof;
d) the construction inspection certificate, if issued;
e) declarations of submission to laws suspending the imposition of sanctions on arbitrary;
f) floor plans showing the building in its actual condition, where it does not appear from the details of items a`, b` and e`;
g) the structural vulnerability sheet or the technical report of static control, which accompanies the application for inclusion in Law 4178/2013 (A` 174) or the present (L.4495 / 17) or the static adequacy study, if required, in accordance with Article 99 of Law 4495/17,
h) the table of ownership percentages or the study of the distribution of costs of the building if any.
i) the title deed
j) copy of the cadastral sheet
Electronic Identity Documents of Divided Independent Property
a) the executive of the building permit of the building in which the divided property is located with its revisions;
b) the plans accompanying the building permit, as well as the accessibility study of persons with disabilities and persons with disabilities, if required. If the building permit and the accompanying data are not found in the records of the relevant service, a certificate of loss is submitted instead by the competent Building Service.
c) the energy performance certificate of the divided property;
d) the construction inspection certificate, if issued;
e) declarations of submission to laws suspending the imposition of sanctions on arbitrary;
f) floor plans showing the split property in its actual condition, where it does not appear from the details of cases a`, b` and e`, except for the common areas;
g) the structural vulnerability sheet or the technical report of static control, which accompanies the application for inclusion in law 4178/2013 or the present (Law 4495/2017) or the static adequacy study, if required, according to article 99 of L. 4495/17,
h) the table of ownership percentages or the study of the distribution of costs of the building if any,
i) the title deed
j) the establishment of horizontal/vertical properties, together with the accompanying plans
k) copy of the cadastral sheet.
In case the competent authorities find an illegal completion of the Electronic Identity of a Building or Divided Property, fines from € 2,000 to € 20,000 are provided and the competent engineer is punished with a disciplinary penalty of temporary or permanent deprivation of the license, depending on the severity. which is imposed by the competent bodies.
